How NY Inspects Diesel Vehicles.

Diesel rules are different from gas car rules. Two things decide what your diesel needs: how much it weighs and where it is registered. Here is the full breakdown in plain language.

If your diesel weighs more than 8,500 pounds and you live in one of nine specific counties around NYC, you need an annual diesel emissions inspection. Everyone else has different rules. Keep reading to find yours.

The Two Factors

What Decides Your Diesel's Rule

NY State sorts diesel vehicles by two things. Get these right and the rest of this page makes sense.

1. The weight of your diesel

The number to know is 8,500 pounds. This is the Gross Vehicle Weight Rating (GVWR) or Maximum Gross Weight (MGW) listed on your vehicle registration certificate. Most personal diesel pickups (Ford F-250, Ram 2500, GM 2500) are right around this number, so check your registration carefully.

  • Over 8,500 pounds: You may need the diesel emissions inspection
  • 8,500 pounds or less: You get the regular OBD II test, same as gas cars

2. Where the vehicle is registered

NY State has a special zone for diesel emissions called the DEMA (Diesel Emissions Metropolitan Area). The DEMA covers nine counties around New York City. Rules are stricter inside the DEMA.

  • Kings (Brooklyn)
  • New York (Manhattan)
  • Queens
  • Richmond (Staten Island)
  • Nassau
  • Suffolk
  • Rockland
  • Westchester
Wait, Isn't That the NYMA?

Yes. The DEMA covers the exact same counties as the NYMA (the area on the regular VS-77 fee chart). New York uses different names for the same area depending on the regulation. DEMA is for diesel, NYMA is for gas vehicles. Same nine counties either way.

Three Different Rules, One of Them Applies to You

Heavy Diesel Inside the DEMA

Diesel vehicles over 8,500 pounds registered in any of the nine DEMA counties (NYC, Nassau, Suffolk, Rockland, Westchester).

Your rule: Annual diesel emissions inspection required. It happens at the same time as your safety inspection. The model year does not exempt you. The only exemptions are listed in section 79.2(h) of the DMV's CR-79 regulations.

Safety: $20 + Diesel emissions: $25 = $45 max

Annual Required

Heavy Diesel Outside the DEMA

Diesel vehicles over 8,500 pounds registered anywhere in NY that is NOT one of the nine DEMA counties. This covers most of upstate, the Adirondacks, the Southern Tier, Western NY, and the North Country.

Your rule: No annual diesel emissions inspection required. But you can still be stopped for a random roadside emissions check by NY State Police, DEC, or DOT. Fines for failing a roadside check are steep (more on that below).

Safety only: $20 max

No Annual Test

Light Diesel (8,500 lbs or Less)

Diesel pickups, SUVs, or cars with a GVWR of 8,500 pounds or less, registered anywhere in NY. This is the rule for most personal diesel vehicles.

Your rule: Treated like a regular gas car. You get the OBD II emissions inspection. Same age rules apply: model year must be between 2 and 25 years old. Vehicles outside that range (very new or very old) are exempt.

Safety: $10 + OBD II emissions ($11 or $27 by location) = $21 to $37 max

The Roadside Rule

Any Heavy Diesel Can Be Stopped for a Roadside Check

This is the part many diesel owners do not know about. Even if your truck does not need an annual emissions inspection, it can still be pulled over for a spot check.

Who can stop you

Three NY State agencies run roadside diesel emissions inspections:

  • NY State Police
  • NY State Department of Environmental Conservation (DEC)
  • NY State Department of Transportation (DOT)

Who can be stopped

Any diesel-powered vehicle with a maximum gross weight over 8,500 pounds, registered anywhere in New York. It does not matter if you are inside or outside the DEMA. The roadside rule applies statewide.

The fines

The fines for failing a roadside diesel inspection are significant:

First offense $700
Second or later offense $1,300

How to reduce the fine

If you fail a roadside inspection, the fine can be reduced. Repair the vehicle and pass a re-inspection at a DMV-licensed facility within 30 days of the violation. Bring the proof of repair and the passing re-inspection certificate to court.

Traveling With Your Heavy Diesel

What If Your Inspection Expires While You Are Out of the DEMA?

If you live in the DEMA but you are working or traveling outside it, and your diesel emissions inspection certificate expires while you are gone, you have an option.

The Temporary Certificate of Emissions Waiver

NY State offers a special waiver called the Temporary Certificate of Emissions Waiver (form VS-1078). It is meant for diesel owners whose inspection runs out while they are outside the DEMA. Here is how it works:

  • Where to get it: Only at DMV issuing offices in person
  • What it does: Lets you operate your vehicle while outside the DEMA, as long as you also have a valid safety inspection
  • What you need: Display the waiver on the vehicle along with the safety inspection certificate
  • How long it lasts after you return: 10 days from the date the vehicle returns to the NYMA (DEMA)

The 10-day clock starts the moment your vehicle is back in the metro area. You need to get a real diesel emissions inspection within those 10 days.

Diesel Inspection Questions People Ask

Do all diesel trucks in NY need an emissions inspection?

No. Only heavy diesel vehicles (over 8,500 pounds) registered in the DEMA need an annual diesel emissions inspection. Heavy diesels outside the DEMA do not need one, but can still be checked at random roadside stops. Light diesel vehicles (under 8,501 pounds) get the regular OBD II emissions test, the same as gas cars.

What counties are in the DEMA?

DEMA stands for Diesel Emissions Metropolitan Area. It covers New York City (Bronx, Kings, New York, Queens, and Richmond counties) plus Nassau, Suffolk, Rockland, and Westchester counties. That is the same nine counties as the NYMA from the regular fee chart, just under a different name.

Does my diesel pickup truck need a diesel emissions test?

How much does a diesel emissions inspection cost?

The diesel emissions inspection is $25. This is added to the safety inspection fee, which is $20 for heavy vehicles. So a heavy diesel in the DEMA pays $45 total at most.

What if I move my heavy diesel out of state temporarily?

If your diesel emissions inspection certificate expires while you are outside the DEMA, you can apply for a Temporary Certificate of Emissions Waiver (form VS-1078) at any DMV issuing office. With this waiver and a valid safety inspection, you can keep driving the vehicle outside the DEMA. The waiver gives you 10 days to get a real diesel inspection once you return.

Are any diesel vehicles fully exempt from emissions inspection?

Yes. For light diesels (under 8,501 lbs), the model year rule applies. Vehicles less than 2 model years old and more than 25 model years old are exempt from OBD II emissions inspection. So in 2026, that means model years before 2002 and model years 2025 or newer are exempt.

For heavy diesels in the DEMA, the exemptions are very limited and listed in section 79.2(h) of the CR-79 regulations. Most heavy diesels in the DEMA do need the annual inspection regardless of model year.
